Terms of Services
These Terms of Services govern your use of Sinuous mobile’s services and applications.
Definitions
- Sinuous Services: All functionality and applications provided on the web site(s), mobile applications and desktop applications provided by Sinuous mobile.
- Mobile Application: An application intended to be installed and used on mobile devices (like smartphones or tablets) created using Sinuous Services.
- Content: All assets/media files (like images, audio files, videos, text files) used for the creation of Mobile Applications.
- Production: Use and distribution of an application with the intention to use it for a business, during or for work to improve productivity or distribution to users through any kind of apps stores.
By using the Sinuous Services, you agree to be bound by these Terms. If you don’t agree to these Terms, do not use the Sinuous Services.
If you are using Sinuous Services on behalf of a third party, like your employer, you may do so only if you have proper authorization to do so by the third party. It is your sole responsibility to ensure you have the authorization.
We may modify the Terms of Services at any time, in our sole discretion and without notice. The latest version is always accessible through www.sinuousmobile.com/terms.html.
Eligibility to Use Service
You may use Sinuous Services only if you are old enough (in most countries 18 years and older) and capable of forming a binding contract with Sinuous mobile.
Use of Sinuous Services is contingent on review and approval during a registration process. Sinuous mobile reserves the right to decline services to anyone without notice.
Rights and Terms for using Sinuous Services
To use the Sinuous Services you’ll have to create an Account with Sinuous mobile. You agree to provide accurate, complete and up-to-date information during account registration and setup (e.g. your real name and current email-address). You also agree to keep it up-to-date without reminder from Sinuous mobile.
You ensure that you own the copyright for all Content you use with Sinuous Services. Sinuous mobile may store the Content on servers for providing the Sinuous Services. By uploading, either explicit or implicit by building an app) the Content you confirm the ownership of the copyright for all Content used and allow Sinuous mobile the storage on servers on your behalf.
You organize the backup of all your Content stored on Sinuous mobile servers on your own. Sinuous mobile services are not to be used as a backup services and we do not guarantee availability beyond individual Sinuous Service operations.
Sinuous Services are currently in beta release and hence may not be used in production scenarios unless you enter an additional written agreement with Sinuous mobile. We reserve the right to limit the free service offerings at any time, in our sole discretion and without notice.
Rights and Terms for Mobile Applications created with Sinuous Services
Sinuous Services allow you to create Mobile Applications. You only have the rights to use and distribute the Mobile Applications if you have an active account with Sinuous mobile. If you choose to cancel the account and service contract you may not continue to use or distribute the Mobile Applications you created using Sinuous Services. If Sinuous mobile terminates your account you are required to stop using and distributing all Mobile Applications you created using Sinuous Services associated with the terminated account.
You ensure that you own the copyright of all Content used for creating the Mobile Application.
You have the sole responsibility for all features, functions and Content of Mobile Applications. You ensure that Mobile Applications adhere to legal requirements.
Distribution of Mobile Applications is your sole responsibility and it is your responsibility to adhere to all legal requirements.
Mobile Applications are provided as beta software/releases and hence may not be used in production unless you enter an additional written agreement with Sinuous mobile. We reserve the right to limit the free service offerings at any time, in our sole discretion and without notice.
Warranty Disclaimers
The Services and Content are provided “AS IS,” without warranty of any kind.
Sinuous mobile may change features and functions at any time, at our sole discretion and without notice.
Limitation of Liability
You agree that neither Sinuous mobile nor any of their respective officers, directors, employees, owners, agents, representatives and licensors, shall be liable for any damages, whether direct, incidental, indirect or consequential, arising from any use by you of the Sinuous Services or Mobile Applications, even if such parties have been advised, or advised of the possibility, of such damages.
Indemnity
You will indemnify and hold harmless Sinuous mobile from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees arising out of or in any way connected with (i) your access to or use of the Sinuous Services, (ii) your Content, or (iii) your violation of these Terms.
Termination
We may terminate your access to and use of the Sinuous Services, at our sole discretion, at any time and without notice to you.
You may cancel your account by sending an email to service@simoap.com.
If you fail to provide accurate, complete and up-to-date information during account registration (e.g. real name and current email-address) or do not keep it up-to-date we may terminate your account and decline future services to you.
If you fail to comply with terms and services for Sinuous Services and terms and services for Mobile Applications created with Sinuous Services we may terminate your account and decline future services to you.
If your account was terminated you may not create an account under a different email address.
